Public School Child Abuse Cases
When you find out your child has been hurt or abused in school, it is one of the worst feelings a parent can have. It can feel like the school administrators let you down and betrayed you by letting your student get hurt. You may feel like the abusive school employee needs to pay.
There may be grounds for a federal lawsuit against a Michigan public school, its administrators, and the abusive employee. Depending on the nature of the harm, there may also be criminal charges involved.
But these cases are not easy. Government employees like public school superintendents, principals, and teachers are protected by a legal shield called “governmental immunity.” This defense protects state actors from getting sued for doing their job. To be compensated for your child’s injuries you will have to prove that the school was “grossly negligent” in preventing and responding to your student’s injuries.
